Terms of Service

These Terms of Service ("Terms") govern your access to and use of the software, websites, and services provided by Greetform ("greetform," "we," "us"), including greetform.com, app.greetform.com, and any onboarding flows we host on behalf of a newsletter operator. By accessing or using the service, you agree to these Terms.

1. The service

Greetform is subscriber onboarding and offer-routing software for newsletter operators. Operators connect their newsletter, configure surveys and offers, and greetform routes qualified subscribers to local business buyers as leads. The service is provided as-is, with the features available at any given time.

2. Accounts and access

To use the operator dashboard you must create an account, keep your login credentials confidential, and be responsible for activity under your account. You agree to provide accurate information and to update it as needed. You must be at least 18 years old and authorized to enter into a binding contract.

3. Acceptable use

You agree not to:

• Upload subscribers without a lawful basis, valid opt-in, and the right to share their data with the local businesses you have configured as offer buyers.
• Use the service to send unsolicited commercial email or to violate any anti-spam law (including CAN-SPAM, CASL, or GDPR e-privacy rules).
• Misrepresent the source of an offer or the identity of the business behind it.
• Attempt to probe, scan, reverse engineer, or otherwise interfere with the service.
• Use the service for any unlawful, fraudulent, harassing, or deceptive purpose.

4. Operator responsibilities

Operators are the data controllers for their subscribers. You are responsible for: posting an accurate privacy notice to your subscribers, honoring opt-out and deletion requests, and ensuring the offers you route comply with applicable advertising and consumer-protection rules.

5. Fees and payment

Greetform is currently delivered as a hands-on service to a small set of newsletter operators. Pricing, billing cadence, and refund policy are documented separately in your operator agreement. If you do not have an operator agreement, you are using the service in evaluation mode and no fees are owed.

6. Intellectual property

Greetform retains all rights, title, and interest in the software, design, brand, and content we create. You retain rights to your operator content (surveys, offers, brand assets, subscriber lists). You grant greetform a limited license to use that content solely to operate the service for you.

7. Third-party services

Greetform integrates with Supabase, Vercel, Resend, Beehiiv, TidyCal, and other third parties. Your use of those services is also governed by their terms. We are not responsible for outages or behavior in third-party services we do not control.

8. Confidentiality

Each party agrees to keep the other's non-public business information confidential and to use it only as needed to perform under these Terms. Subscriber data is governed by the Privacy Policy.

9. Termination

Either party may terminate this agreement on written notice. We may suspend or terminate access immediately if you breach these Terms or use the service in a way that risks harm to subscribers, business buyers, or greetform. Upon termination, your access ends and we will delete operator data per the Privacy Policy retention schedule.

10. Disclaimers

The service is provided "as is." We do not warrant that the service will be uninterrupted, error-free, or produce any particular lead volume or revenue outcome. To the maximum extent allowed by law, we disclaim all implied warranties.

11. Limitation of liability

Greetform's aggregate liability under these Terms is limited to the fees you paid us in the twelve months before the claim, or one hundred US dollars, whichever is greater. We are not liable for indirect, incidental, or consequential damages.

12. Indemnification

You agree to indemnify greetform against any claim arising from your subscriber list, your offers, your relationships with local business buyers, or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Williamson County, Texas.

14. Changes

We may update these Terms from time to time. Continued use of the service after the "Effective" date constitutes acceptance of the updated Terms.
